a) because there is no real law against being a moron. And lack of environmental protection removed the big predators like sabre-toothed tigers before they could thin out all the "idiot" genes. :s
b) only for short periods of time. They would probably take up all the parking slots at malls and strip malls, then have accidents trying to leave the lots at the end of their calls.

During that monster fog that caused like 145 wrecks at once
a few years ago (I-5) my dad and Mom were slowing down cause the fog was way too thick...
this lady pastes my dad, Side swipes the trailer and slamed the bumper of his truck. She tells the CHP. If He had not slowed down I would not have hit him,Officer. Mam wait a moment (goes and gets another CHP)
mam can you repete what you just said??? Yeah I said if he wasn't driving so slow I would not have hit him. Officer..Did you see Him prior to hitting him?? NO I was driving too fast to see him untill I hit him.
If I'm not mistaken, the rule in NY is strange. I believe driving while using a cellphone is illegal, but they cannot pull you over for that reason. If they have a second reason to pull you over, they can then ticket you.
I know. It makes no sense, but I work in NY and everyone at my job says that is the case.

It would be similar to a seat-belt violation. An officer has to have probable cause to stop you. If, during the process of the stop, he discovers you were not wearing your seat-belt, that goes on top of any other ticket.
While I support the idea needing a reason to perform a traffic stop to check for a seat-belt violation (that whole pesky "freedom from illegal search and seizure" thing), something as obvious as talking on a cellphone with the thing against your ear in traffic doesn't seem to fall into that same category.
