What to do...
WEll my aunt sent me a package for Christmas, and accidentally sent it to my old address. So I went to my old address to ask if they received it and they sais no. I asked if they did get it to call me and left my number. I never received a call and just figured it was never delivered or they returned it knowing I was looking for it. Well it was insured so my aunt has been delaing with the post office and someone told het that you could cancel the card if it had not been used to get your money back or a new card. So she called and sure enough, it had been spent. They could tell her the date and time and everything when it had been spent. I plan on going to the house and asking them about before I go to the cops. Is it worth going to the cops? I mean isnt it like mail tampering, and larceny and stuff??? What do I do????????

definitely mail fraud - as for larceny - depends on the value of the card - I'd DEFINITELY go to the cops. Did anyone go with you when you went to the old address the first time? Not that I know of..but since they know the date and time, I presume they could figure out the register as well and see video of it...Not that they would go through all that for $100 gift card...but maybe. I know th epost office isn't to happy about have ing to give my aunt money so they may be the ones to crack down!! That could be a federal offense. They stole your mail. I kept getting someone else's mail (it was the mailwoman's fault), a couple of times it was their CREDIT CARD BILL!
If I had kept it, and got caught, I woulda gone to jail. These people also got MY mail, mistakenly...good thing we're both honest people, huh? The mailwoman apologized to us, but did it a few more times anyway. SHEESH!

something that did not get returned and did not get sent back
My sis just got off a job where she spent a lot of time with the PO
and she told me to tell you. "let the Post office sort it out."
fill out the insurance forms and let the whole thing go from there.
OH and taunt them when they are in court.

Ask to speak to the local Postal Inspector.
File a report with your local police.....we deal with these sorts of things quite often. If it hasn't been too long since the card was used, the store it was used at may have video and be able to determine it really was the turds at your old apartment. Most larger department stores keep their video for at least 45 days.
After all that, let's just go beat them up.....stealing a Christmas present, that's cold.

That would depend on the type of "Gift Card". Some require it, some don't. The more credit-card style gift cards will require it but it probably varies from retailer to retailer how they handle it. I hope they FRY! Just kidding! But I definitely think legal action is warranted! Also, confronting them again may encourage them to "get rid of the evidence" of whatever they purchased if they know something's up.CaptainP wrote:True. I definitely would NOT go to the house again.... lots of bad things could happen, and nothing good......
there's also the remote possibility that the package was either stolen enroute or stolen from their porch.
I like the idea of checking for video at the store where the card was used. But let the police do it.....

THESE PEOPLE TOOK SOMETHING THAT DIDN'T BELONG TO THEM, USED IT, AND THAT IS THEFT!
AND, SINCE IT'S U.S. MAIL INVOLVED, IT'S A FEDERAL OFFENSE.
LET'S GIVE THESE PEOPLE THE PUNISHMENT THEY DESERVE!

Ok so I went to the police and filed a report. A few hours later a HOT hot cop (did I mention he was hot) came to the house and said they of course said they didn't know anything. What I didn't remember before was that all packages go to a locked mailbox at the end of the street (well its been a few years since I lived there, I just forgot). Anyway, the cop has only been on the force for a few months so this will be his first "bust" and since its a FEDERAL crime he is all excited. Anyway so he is working even on his days off to go to Target and get the video tape of the register where the card was cashed. He was appaled that someone would steal Christmas presents...he also has kids so he noticed when I put down that someone stole an Elmo dvd...lol. Anyway, I'll keep you updated!!!! Also since he is new, he wasn't sure which crimes had been commited, so as a 4th year crim jus student we made up a list...Mail tampering, petty larceney, obstruction of justice (lying to the hot cop). Can ya think of anything else???
