so i'm in a slight pickle here. i worked at this company for a month and after i stopped working there, someone else's paycheck was appearing in my bank account. i filled out a direct deposit form when i was hired, but i never got any deposits for my paychecks. they sent those in the mail. however, some random person's check was being deposited. i just got a voice mail saying that they would prefer to resolve things amicably, but would take legal measures if necessary. needless to say, i've spent a lot of that money. any advice? informative friendly advice from your prior experience would be helpful.

Uh....you accepted and spent money meant for someone else?

WHOOPS!!
Methinks you might have to give it back.
Methinks you also might have 'sexually violated' the pooch.

Bank error, payroll dept error or who ever's error... the money was not yours to spend.
Legally you have stolen that money. Call the person and set up an arrangement to repay the money.
After all..... some one else didnt get a paycheck and you got TWO!

Not a lawyer here, but common sense says it's stolen money. If you receive money from someone/somewhere and it's not yours? You don't spend it, you need to give it back.

If you're still here in Utah......it falls under
76-6-407: Theft of lost, mislaid or mistakenly delivered property.....
Better return the phone call and take that "amicably" option!!
I believe that would be "Press 2" for humble apology and prompt offer of repayment!

Sometime back,
I was overpaid by a company I worked for once....by a very large sum.
I made the mistake of opening my mouth about it. What I should have done was kept my mouth shut, and opened a new account and collected the interest off of it...and waited until they caught the mistake.
I had a ALOT of fun convincing them that "THEY" made the mistake and had quite a few short paychecks because they told me to not worry about it...and refused to cut me a proper check, they would not accept my personal check or money order to pay them back at that time. So they took it out that way. From now on IF that ever happens again.....it will go into a new and separate account. Dishonest... perhaps...but I don't really think so. Ripping someone off??? No!
What about the attitude they were giving me about "They don't make those kind of mistakes!"?
Just not wanting to deal with the headaches and hassles that I was presented and be treated like it was my fault to start off with and No I would not spend or touch the money. Just let it grow until they want it back. It took a while to straighten out....I would not want to go through it again.
A few weeks after it was settled....I met with the company owner that came to the job site and was given a thank you for my honesty........GEE what were my options? Wouldn't take long to figure out where the money went when they started looking for it....even so...keeping and spending it and not expecting to pay it back would be WRONG......
