I think a .08 legal limit is ridiculous as for a person who weighs 100 lbs, it likely would only take one drink to be considered DWI.

There is no good reason why all the States went from .1 to .08 other than to raise money.

If Paris really had a drinking problem she would have been way past .08 at 1 am.

So now an entire criminal case has to be started and a Judge or Magistrate (as well as Ct clerks, probation officers, etc) have to waste their time on a chicken $hit charge that will just waste time/$ and will result in probation and some court costs. Otherwise, should she fight it and get the case dismissed (assuming you can get a jury in CA for DWI - you can in MI where I practice) 12 or 13 jurors will waste a day of their lives on a stupid, pittance of a case.

The sad thing is for most of us, the thousand of dollars in Ct costs/atty fees we can incur in fighting such a BS charge are a hardship. All just to keep the gov't in our lives just a little more.

If one drink makes you drunk, don't drink. Or get a designated driver.

BS charge? Drunk. Impaired. Liable to kill someone.

I'm going to guess that maybe a drunk driver has never killed or maimed anyone close to you..... :-?

The government wouldn't be in our lives on this issue if people could/would control how much they drink before they get behind the wheel....

A DUI arrest isn't about finding people with a drinking problem....it's about getting impaired drivers off the road.....I don't care if she has a drinking problem....but if she was driving erratically, as was reported, and was impaired....she needed to be taken off the road.
