buffett music in commercials

A small local business is using volcano in their radio spot. I"m wondering if it will get ignored or he'll get busted on copyright infringement. I have no problems with it, in fact i'll probably stop in the store because of it. But i've heard JB and his org are tough on things like this.

you may be able to buy the rights to use music without going through the artist....

ASCAP and BMI sell licenses to use copyrighted songs, and other stuff. They probably have 98% of everything that's available commercially.
