I'm sorry that he went so young. BUT IMHO each person
is responsible for themselves..
So you're speeding down the highway drunk, yakking on a cell phone, without a seatbelt and when you run into a tow truck trying to help a stalled car it is the fault of the driver of the stalled car and the tow truck driver????
Who would even dream of bringing a case like this??? If I were his family I would be apologizing to the tow truck driver not suing him
Well I hate to say this-- But I do not think his family has any recourse with the tow truck driver or people in the car. The only people he can sue is the people who supposedly overserved him. Who knows if he was drinking in his truck on the way and threw out the bottle.
His family should be more worried bout the tow truck driver sueing them.

I know that my husband attends "after hours" social functions with employees, but is very careful to ensure that he never pays for alcohol for them...only food.
There have been cases where people who brought their own alcohol to parties at someones home then left have been able to hold the host of the party liable for the accident they later had.
The host "should have" kept the person at their home till they sobered up, even though the host didn't directly serve them any alcohol.
Even people trying to avoid driving while intoxicated who were ASLEEP in their own PARKED car have been cited for DUI because they were in the drivers seat instead of some other seat in the vehicle. How nuts is that?

We have a local bar that does EVERYTHING it can to entice the young barely 20 somethings in. Every Thursday is $1.00 well drinks The bar DOES NOT HELP parents trying to help thier kids, "grow up." I agree everyone MUST be responsible for thier actions, but what we don't need is the peer pressure and the discount bar at the same time. They may lose thier license for thier poor actions.

Sadly, we live in a victim society. Everything we do wrong is always somebody else's fault. Nobody can be held accountable for their actions. They were deprived of Jello as kids, or McDonald's made their coffee too hot, or the bar actually served them drinks when they ordered them.
People have to man up and be accountable for their own actions. It's called free will people. You make a choice or make a mistake, well, deal with the damn consequences.
We need a "loser pays" legal system. It would stop every dipstick in the country from filing suits like this if they had to pay the other sides legal expenses after the judge threw their sorry ass out on the street.
