Obama & DNC Admit All Allegations of Federal Court Lawsuit regarding Obama's "Not" Qualified to be President and Obama Should Immediately Withdraw his Candidacy for President

(Lafayette Hill, Pennsylvania ­ 10/21/08) - Philip J. Berg, Esquire, the Attorney who filed suit against Barack H. Obama challenging Senator Obama's lack of "qualifications" to serve as President of the United States, announced today that Obama and tbe DNC "ADMITTED", by way of failure to timely respond to Requests for Admissions, all of the numerous specific requests in the Federal lawsuit. Obama is "NOT QUALIFIED" to be President and therefore Obama must immediately withdraw his candidacy for President and the DNC shall substitute a qualified candidate. The case is Berg v. Obama, No. 08-cv-04083.

Berg stated that he filed Requests for Admissions on September 15, 2008 with a response by way of answer or objection had to be served within thirty [30] days. No response to the Requests for Admissions was served by way of response or objection. Thus, all of the Admissions directed to Obama and the DNC are deemed "ADMITTED."

Therefore, Obama must immediately withdraw his candidacy for President.

Last night a major announcement: Obama is taking a few days to hurry to Hawaii. His grand mother is sick. The media has zero details on this illness or why Obama has to drop his campaign plans and run to Hawaii.

This is the latest from Phil on his lawsuit re Obama's birth certificate --- a Hawaiian one.

I absolutely wish no ill will towards Obama's grandmother, but it sure it seems like a huge coincidence considering the timing of Phil's release. If I lived in Honolulu where the State Department of Health issues birth certs, I'd be camped out there just to see who shows up in the next few days....maybe Michael Signator.

This press release should be taken or faxed TODAY to every Secretary of State of the Union with a polite demand that Obama be declared ineligible to appear on the ballot.

If you have a radio show, I hope you will air this press release.

FAX it to your state rep and state senator.

FAX it to your local county clerk with a short letter letting him/her know Obama cannot be an eligible candidate on election day because - include the legal definiton of 'request for admissions.'

One of the most intense allegations of the ongoing lawsuit against Sen. Barack Obama alleging ineligibility for the presidency is whether or not Mr. Obama can produce his birth certificate.

If Mr. Obama were to produce his birth certificate, it would lay the entire question to rest. It would prove, beyond a reasonable doubt, that the U.S. government officially recognizes Mr. Obama's citizenship. The Obama campaign says that it has already produced this document, a scanned copy of which is available at the campaign's "Fight the Smears" Web site.

One point critics of Mr. Obama have made is the fact that the document posted is not, in fact, a birth certificate. It is a birth certification, which is a computer-generated printout of a birth record. A certification is a cheap print-off for people who have lost their original birth certificates. For most people, there is little practical difference between a certificate of live birth and a certification of live birth, although the certification requires extra verification when being used like a birth certificate.

Because of the tenuous nature of identifying a certification of birth as genuine, it requires an embossed seal and authoritative signature. The low-resolution scan available on the Obama campaign Web site appears to have neither of those. The ink from a date stamp, "June 6, 2007," is visible clearly, but it appears that the document does not have a seal or signature. The campaign only scanned the front of the document.

Without the seal and signature, the document on the Obama Web site lacks legal weight, and does not count as representing the official birth record of Mr. Obama.

Philip Berg, a former deputy attorney general for Pennsylvania, has filed suit against Mr. Obama, alleging that he is not legally qualified to serve as president. He has indicated that if Mr. Obama were to produce certified documents proving that he is a natural born citizen, he will withdraw his case.

Mr. Berg maintains that Mr. Obama is not a natural born U.S. citizen, but others wonder if there are more reasons why Mr. Obama and the Democratic National Committee have not laid the question to rest by releasing the documents. Some think that there may be embarrassing information about Mr. Obama that could be inferred from the papers.

The original birth certificate would normally have an entry for religion, and many suppose he would have been listed as Muslim, an image Mr. Obama has worked hard to distance himself from. Others think it might have shown that his parents were not legally married, even though Mr. Obama contends that his parents were married in good faith before separating upon discovering his father had never divorced his last wife.

The Obama campaign says that the idea that Mr. Obama is not natural born is preposterous and cites the certification of birth as an example. But until a physical and verifiable document is produced for their critics, the lawsuit is expected to continue.

WHERE IS OBAMA'S?

To this date, Barack Obama has refused - or been unable -to produce an authentic birth certificate that attests to the fact he is an American-born citizen. He has had more than the two-years of campaigning for the presidency of the United States to do this, but failed.

Why is this important? Because the Constitution of the United States expressly forbids anyone born on foreign soil to run for the highest office in our land!

You would think that Obama would have volunteered the "proof" of his eligibility within a nanosecond of entering the race. But here we are, less than two weeks away from the election, and Americans still don't know if Obama is an American!

While Obama's camp submitted a supposedly authentic birth certificate to the far-left blog Daily Kos, it was found to have been a photo-shopped version of the birth certificate of his half-sister, who was actually born in Hawaii, as Obama claims he was.

While this glaring omission in Obama's eligibility to become the most powerful man on earth mystified some and rankled others, a few people - clearly alarmed at what they considered a stealth candidate's attempt to dance his way around the Constitution and venture into the realm of criminality- took action.

SLEUTH #1

The first sleuth was lawyer Philip J. Berg, a Democrat from Pennsylvania and an undisguised Hillary fan.Last August, Berg - a former deputy attorney general of Pennsylvania and one-time candidate for both governor and senator -filed a lawsuit in Federal Court (Berg vs. Obama, Civil Action No. 08-cv-4083) seeking a Declaratory Judgment and an Injunction against Obama, alleging that the first-term Illinois senator did not meet the qualifications to be President of the United States.

Berg's suit was based on Obama's failure to answer satisfactorily the question of where he was born. Was it in Hawaii, Kenya, or Indonesia? Was his legal name Barack Hussein Obama, Barry Soetoro (his stepfather's surname), Barry Obama, Barack Dunham (his maternal grandparents' surname), or Barry Dunham?

Among the other questions Berg raised were the authenticity of the name Obama used on his Illinois Bar Application and his possible allegiance to other countries.

"Voters donated money, goods and services to elect a nominee and were defrauded by Senator Obama's lies and obfuscations," Berg said. "He clearly shows a conscience of guilt by his actions in using the forged birth certificate and the lies he's told to cover his loss of citizenship. We believe he...supported this belief by his actions in hiding his secret, in that he failed to regain his citizenship and used documents to further his position as a natural born citizen...His very acts prove he knew he was no longer a natural born citizen. We believe he knew he was defrauding the country or else why use the forged birth certificate of his half sister?...If the DNC officers and/or leaders had performed one ounce of due diligence, we would not find ourselves in this emergency predicament...from making a person the nominee who has lost their citizenship as a child and failed to even perform the basic steps of regaining citizenship through an oath of allegiance at age eighteen [18] as prescribed by Constitutional laws!"

The net result of Berg's efforts was that, on September 9, both Obama and the Democratic National Committee filed a joint motion for a Protective Order to Stay Discovery pending a decision on the Motion to Dismiss his lawsuit. In other words, to make Berg's lawsuit go away!

Berg said he was "outraged, as this is another attempt to hide the truth from the public; it is obvious that documents do not exist to prove that Obama is qualified to be President." The joint motion, Berg asserted, was a concerted effort to avoid the truth by attempting to delay the judicial process, although legal, by not resolving the issue presented: that is, whether Barack Obama meets the qualifications to be President. He said it is obvious that Obama was born in Kenya and does not meet the qualifications to be President of the United States. Simply stated, Obama "is unable to produce a certified copy of his Birth Certificate from Hawaii because it does not exist."

An e-mail friend of mine, a lawyer, stated: "What has boggled my mind about this case is that Berg simply waited for a court order to compel the production of the birth certificate, when he could just as easily have served a subpoena on the Hawaii County Clerk or County Recorder - or whoever is the custodian of records in Hawaii - to produce the original birth certificate for examination by an expert forensic-document examiner to produce certified copies to the Court, the Plaintiff, and the Defendants, which would have shifted the burden to Obama to quash the subpoena - and if he filed a motion to quash the subpoena to produce his own birth certificate, that would sure as hell tell us that he has a lot to hide."

WEST PALM BEACH, FL -- It's been Internet gossip for months. Is Barack Obama a U.S. citizen?

Nonetheless an attorney in Philadelphia, Philip Berg, filed a lawsuit claiming Obama lost his U.S. citizenship when his mother married an Indonesian man. Berg says Obama failed to take an oath of allegiance when he turned 18.

Obama has attempted to silence any critics by producing a birth certificate from Hawaii, proving he was born there in 1961. Berg however is demanding an original, and not a copy from the Obama camp.

Obama's team filed a motion to dismiss Berg's lawsuit, but they also made a motion to block discovery.

Brian Smith is a West Palm Beach attorney registered as an Independent, that has wrote about this issue from a legal standpoint on his blog.

"The Obama camp and Democratic National Committee responded to the lawsuit by filing a motion to dismiss, but they never responded to the request for admissions."

Berg is now arguing because Obama's camp is refusing to produce an original birth certificate copy in discovery, his allegations are essentially true.

"Wednesday he filed a motion for summary judgment, or a judgment in his favor, as a matter of law, because they essentially admitted those allegations. That from a legal perspective is huge," says Smith.

This is the third lawsuit that's been filed about Obama's citizenship, meaning the courts will have to decide how to move forward. A Washington man, Steven Marquis, is suing the Washington Secretary of State, demanding that he verify Obama's citizenship status before the election.

In Honolulu, Andy Martin filed a lawsuit on October 17th, to get the Hawaiin Department of Health to release Obama's birth certificates. Martin also wants to see an original birth certificate, and not a 'copy.'

Smith says under Hawaiin law birth certificates are considered private.

Meanwhile, Judge R. Barclay Surrick is hearing Berg's case in Pennsylvania. The suit was filed on August 21st, but the judge has not made any ruling.

What is certain is that this issue doesn't seem to be going away.

On-line it has a rabid and contentious following from both sides.

Even in the real world, Dr. Watson tells us whenever he speaks publicly, the issue always pops up.

"At this point I think Obama should answer the question. In politics, perception is reality and as long as these e-mails are running wild with conspiracy theories, I think he needs to address it," says Watson.

I question all of it. It's no where to be found anywhere in the news. It's given little to no credibility because this loon has taken exception with many high profile politicians . . . in fact he sued the Bush Administration for their involvement in 9/11 and he sued Florida over the election results of Bush vs. Gore and he asked Supreme Court justices to step down due to a ruling he didn't agree with in regards to that as well.

This is like saying Jack Kervorkian is a solid option as a primary care physician. Yes he is a Dr as Berg is a lawyer but not a socially accepted one.
