There is some additional information reported in this updated story yesterday. Again...keeping in mind that we don't know all the facts....it would appear to me that the school's legal position is slipping away.

A couple of generations ago the administrator would have been slapped in the face for asking such a question, and that would have been the end of the story.

Usually what they mean is . . . whatever supports their position on a given matter. It does seem like the school's legal case may be on shifting ground. A vaguely worded policy about immoral behavior would be open to interpretation and abuse, and therefore might lend weight to the argument that the teacher's dismissal was somewhat arbitrary. Was fornication specifically mentioned on some kind of list? If not, then deciding after the fact on a case by case basis what behavior was grounds for dismissal would seem to leave the school administration open to just this kind of lawsuit.
The question of the teacher's conception date came up during a discussion of a prospective six week maternity leave which the school administration was reluctant to grant due to staffing requirements. Maybe the morality issue was simply a convenient excuse to avoid granting a maternity leave.
The privacy issue would seem to be a "slam dunk". I don't think a former employer is allowed to disclose the personal details of a dismissal to other employees, let alone the community at large, in this case all the parents of the student body.
As someone else pointed out, even though the school is private, a number of federal statutes governing workplace issues would still apply.
