So there you go. If tailgating is the canopies, grills, tables, etc then standing around, walking around, etc shouldn't be an issue.

Not sure they can prosecute if there is nothing more than "No tailgating" stamped on the ticket. I'm thinking they would need to define tailgating as well as post the ramifications if you did so. (like no parking - violators will be towed at owners expenses). But, then again, I'm not going to pull out the VA law code books and check....I'll take my chances :)

Any Virginia legal eagles out there???

The Tailgating question has come up for the Va. Beach concert too. So I sent an email to the Mayor asking what the policy is. Here is the response from his office:

Our City Code prohibits a person from having an open container of alcohol (bottle, cup, etc.) in public places. “Public places” include the parking lot of the Amphitheatre. Last December, City Council amended the City Code to make an exception for “parking areas designed . . . for use by persons attending a collegiate or professional sporting exhibition or event on the day of such exhibition or event.” The ordinance requires that a facility operator seeking such designation apply for the designation and obtain required permits from the Virginia ABC Board. A concert is not considered a sporting event, therefore, having an open container of alcohol in the parking lot of the Amphitheatre before or after a concert would be illegal. These restrictions have been in place since the opening of the Amphitheatre.

To me there are several issues around this city code: 1) A privileged few get to tailgate., 2) Only the alcohol element of tailgating is discussed, 3) Can we tailgate w/o alcohol.. to name a few? As someone mentioned earlier, it seems to becoming the policy at more venus. Just wanted to share this .

Something tells me everyone is getting all worked up for nothing. Why don't we just wait and see how the summer unfolds? There are plenty of events at the Lube before August 27. I think we will all have a better idea of what to expect by then. If this "No Tailgating" policy is supposed to be for all events, then let's see how it is actually enforced before jumping to conclusions. Either way...we will figure out how to have a good time no matter what.

Agreed on all counts. WMZQFest is next month. That should give us a good gauge as to how the Lube is handling things. 311 also plays the venue before JB does. And thanks Carolinadreamin' and bfan53again.

I agree for the Bristow show to wait and see what happens with other evenets there. And I know this is a Bristow thread. However, there may be folks who will be going to both the Bristow and Va. Beach shows (me for one) who would like to know what's going on. The Va. Beach show is May 26 - not much time for finding out info about tailgating there. Just trying to be pro-active and get info where I can and share it with this board.
