what MJCATL2 said... you're legally allowed to make back up copies, encode them to your computer and your ipod... whatever. Just don't give them away.

And I doubt any of the labels are complaining about the warning since all of them are members of the RIAA... The RIAA aren't the nazis of the industry, they ARE the industry.

Where did you hear they were hacking into people's computers? All file sharing programs can track the IP address of the downloader. All they did was get the IP address of the downloader who downloaded certain songs and then subponea the internet provider that has the address range reserved. That is far from hacking into someone's PC.

i burn all my cds so i don't ruin the original..i also download it so i can play everything i own... i buy my favorites and i file share for artists that put 2 good songs on a cd and try to steal my money for $20.. now thats opening a can of worms

You can still use Kazaa easily if you want. Just simply find a program that masks your IP address. It makes it untrackable. I dont advocate it. I'm not going to say its stealing, its just a gray area I dont want to venture in anymore. In college, I was all about Napster and Kazaa, you had to be. Theres no other way a college kid could get music on that budget...haha. Now I just buy the Cd's or get what I want off of iTunes.


Does anyone know if its illegal to download bootleg stuff off of Kazaa? Or things that aren't released on CD? (radio promos, tv specials like VH1 storytellers, etc.)

Technically yes because they're still copyrighted materials, but I suspect the RIAA is less interested in those since it's the labels they represent...

I often wondered how that applied to out-of-print material. If you cannot purchase it retail, does that change anything?

Nope.

I have a whole bunch of new songs that have not been released, but they are copyrighted. As such you can't distribute or copy them even though they're not commercially available.

It's about copyright holders having the right to control their IP.

Frank -

There's actually several artists whose masters are owned by labels and been put out of print. These artists have found a small demand for their work, but not enough demand to convince the labels to rerelease the records. The labels also won't sell the masters to the artists, choosing instead to hold on to the masters for whatever reason...

The result is that even though its known as the artist's album, and the artist could make a decent living off of it, the labels have the copyright and feel it's not worth their while to remanufacture it. So they just sit on it and legally there's nothing the artist can do...

On a similar vein...

If I download a mix of songs off of itunes, or rhapsody etc. and pay for each one, can I turn around and sell that custom mix to someone else? And can I sell it at a profit?

Seems to me I could.

Not by any stretch of the imagination.

You're purchasing a single-copy of each song for personal use, not licensing the songs for distrubution. It makes no difference if it's one song or 100 by different artists - you can't distribute (or re-distribute) the copyrighted material without the permission of the copyright holder.
