Yes, except in cases where the prevailing concern for the public good outweights your first amendment rights or in cases where your speech would infringe upon the rights of others.

Ok, I can buy that. I think it's too broad an interpretation but I can follow and respect the line of reasoning...hippie :D

I dunno... is the decision to wear a helmet or a seal belt covered more by privacy/civil liberties?

Seems like everyone who doesn't want to wear a helmet claims to chose that out of "principle" which leads me to think its speech.... :)

guys,

lee is making great points, but when i said "constitutional right," i mostly meant state constitution. the constitution of the state of louisiana allows people to ride motorcycles without helmets. that STATES RIGHT was granted by the US CONSTITUTION.

you know, if indian larry would have worn a helmet, he might be alive today. but chances are, he'd be a vegetable. im sure, in fact i know, larry would much rather be dead than a vegatable for the rest of his life. i know i would!

and again, this thread was to praise indian larry. if he were here, he would have nothing but positive things to say about every one of us, even though we all have our downfalls. im just a little saddened that some people *cough cough* have a problem with blurting. this thread was positive, until one person *cough* made a negative post. i think we all *cough* should think about what people will say about us when we die and theres a "sail on ________" thread

Oh sure, cut me down. :)

I think he died in North Carolina though, a state that does have a helmet law, but since he was on private property at the time, it wouldn't have been applicable.

Indian Larry was alot of fun to watch on the bike shows.
He will be missed by many.

Whether he should or shouldn't have been wearing a helmet at the time :wink: , he designed some really cool bikes. He was (I think) the only person left who made "spoke" wheels by hand still. He lived a long happy life, doing what he loved. He made a lot of people happy. Not a bad epitaph.

(I own a Harley w/ loud pipes, I believe in helmet laws, my hubby does not, but I still love him and I definitely know he has balls. I know how to choose my battles when it comes to what topics to fuss about with him. :wink: First Amendment according to Auntie) :D
