Chilean appeals court is set to rule on Monday on whether former president Augusto Pinochet is fit to stand trial for alleged human rights abuses.
Gen Pinochet's lawyers are contesting a lower court decision made last week.
The 89-year-old former leader is in hospital after reportedly suffering a stroke. Doctors say he is conscious and no longer in a critical condition.
However, prosecution lawyers said that the reported illness was a "manoeuvre" designed to help him escape justice.
Gen Pinochet, who has a history of health problems including diabetes, was taken ill on Saturday after reportedly feeling ill during breakfast, informs BBC News.
According to the Guardians Unlimited, Chile's former dictator Augusto Pinochet was recovering in hospital from a suspected stroke yesterday, but lawyers pursuing him on human rights charges claimed his illness was a ploy to avoid trial.
The 89-year-old was taken to a hospital on Saturday after feeling ill while having breakfast. Doctors said that he had a stroke. Leonel Gomez, the director of Santiago army hospital, said that Pinochet might be released within the next couple of days. A statement issued by hospital last night said that he had recovered consciousness and mobility and was no longer in a critical condition from the stroke.
The Santiago appeals court decides today whether to uphold Pinochet's indictment and house arrest on charges of kidnapping nine dissidents and killing one during his 1973-1990 regime.
Lawyers representing the relatives of the victims described the news of his stroke as an "old manoeuvre" to keep the former strongman out of court, especially as it came just a day after the appeals court had delayed ruling on the indictment and house arrest.
