Rogue Nation flagless

Post by Sam »

THIS REALLY BLEEPING GETS ME!!!!!
I thought about a Poll on this but decided against it.
You can opine in your post.
I don't understand this at all...look at Memorial Day and Veterans day and Presidents Day, etc....
How many furniture stores and car dealerships use the Flag in promoting THEIR businesses? (not to mention other businesses that do the same that have people wear THE FLAG.)

Does this mean ANYONE or business that shows or wears THE FLAG is supported by the Goverment or that no person or business can wear or show/display THE FLAG without goverment support???

Where is the BLEEPING ACLU on this ???

What a BLEEPING CROCK of BS!!!!

Rogue Nation flagless
Oregon brewery ordered to take flag off bottles of American Amber Ale

Mar 31, 2005 - The government has told Rogue Ales to lower the flag on its American Amber Ale.

The Oregon brewery has been ordered to stop using the stars and stripes to advertise American Amber. According to U.S. Code Title 4, Chapter 1, Section 8, Item I: "The flag should never be used for advertising purposes in any manner whatsoever."

The company began brewing the beer 11 years ago, and uses the flag on beer taps, pint glasses, posters and T-shirts. Even the company's red, white and blue delivery truck will have to be repainted.

"Ours is not to reason why, ours is to comply," said Jack Joyce, Rogue's chief executive officer.

The order came after an agent for the Alcohol and Tobacco Tax and Trade Bureau who was visiting Newport with her family spotted a Rogue delivery truck with a flag painted on it.

A U.S. Treasury Department spokesman said the code is meant, in part, to keep consumers from thinking that the government endorses products.

My father served in WWII, he believed that anyone that wears the flag other than on uniform was being disrespectful. He believed that anyone that displayed the flag in a unpatroitic manner was being disrespectful. He did not believe in the flag on advertising. If the flag touched the ground or became frayed it was burned and the ashes were buried. To him the stars and stripes were sacred, something thousands upon thousands of Americans fought and died for.

That's the way I grew up. If my father were alive he'd agree with this. This is one of the very few things I agree with my father.

IMHO if the government is going to come down on Rogue Ales they should everyone else BUT I don't feel the law should be changed. Just enforced uniformly on everyone.
Well...(said in my best Bubba voice) I've been on sabbatical.

I am all for anyone and any business properly displaying the flag.

I have an American Flag-POW-MIA flag combo on my hat. I see nothing wrong with that. I am a vet and not one vet or anyone else, has ever complained about it.
Let someone try to tell me I am wrong and try to take it off.....

Other people do wear the flag with pride on their uniform, besides the military ( not all military services will allow the wearing of the Flag on the uniform) such as police and fire departments.

It is plainly wrong for the ATF agent to do it in such selective manner. The agent was probably looking for bonus points. I would hope the business would fight it especially after all the other busineses abuse it so flagrantly.

How many cars have you seen with flag decals on them that say Support Our Troops or whatever? How many semis going cross country have the flags on them?

BTW..if memory serves wasn't there a U.S. Postal stamp of the Flag? and what 9-11 memorabilia and photos and the media? The picture of the fireman/rescue workers raising the flag? The raising of the Flag on Mount Surabachi? Etc.......it has been done so many times by so many people in the past and now the ATF pulls this....

Sam, here's a much better story...

Seems that the issue specifically revolves around alcohol and tobacco...
Rogue Ales ordered to pull American flag merchandise
By Laura Eberly Of the News-Times

Following a citation issued by the Bureau of Alcohol, Tobacco, and Firearms (BATF), Rogue Ales has pulled all merchandise depicting the American flag, specifically items related to the promotion of its American Amber Ale.

During the weekend of the Newport Seafood & Wine Festival, held in February at the Rogue Ales brewery in South Beach, a BATF agent spotted a Rogue Ales delivery vehicle sporting an American Amber logo including the American flag. BATF regulations prohibit the use of the American flag on point of sale items promoting alcohol, including beer taps, posters, T-shirts, and delivery vehicles. While a likeness of the flag is allowed, such as the stars and stripes motif used on many items that promote the beverage, an actual depiction of the American flag is not.

Rogue Ales has pulled all point of sale merchandise including the American flag from its pubs in South Beach, Newport, Portland, San Francisco, and Issaquah, Wash., and has removed the offending items from the selection of merchandise offered by its distribution sales representatives to pubs, restaurants, and other businesses across the nation.

American Amber Ale items with a stars and stripes theme - not including the actual American flag - will remain on the brewery's coasters, the ale's bottle logo, and on other promotional merchandise.

As of press time, Rogue Ales had not physically removed items including the American flag from outlets beyond its five pubs that were distributed previous to the BATF citation. The company's attorney is currently reviewing the citation and its ramifications, and is in communication with BATF.
The story you quoted is wrong - it has nothing to do with US Code, but actually with BATF regulations about alcohol advertising, specifically
Any statement, design, device or pictorial representation of or relating to, or capable of being construed as relating to the armed forces of the United States, or of the American Flag or of any emblem, seal, insignia, or decoration associated with such flag or armed forces; nor shall any advertisement contain any statement, device, design or pictorial representation of or concerning any flag, seal, coat of arms, crest or other insignia likely to mislead the consumer to believe that the product has been endorsed, made, or used by, or produced for, or under supervision of, or in accordance with the specifications of the government, organization, family, or individual with whom such flag, seal, coat of arms, crest or insignia is associated.
At least that makes a little more sense.
