On the new Conch republic rum from cruzan???

http://www.cruzanrum.com/product-conch.html

I found it while looking for the new christmas liquor packages, I saw a bunch on display at meijer but they didnt have any cruzan products, does anyone know what they have for christmas yet. Last year it was a free kenny cd and a recipe book with two bottles.

Are you referring to the seaplane used in the logo? If so, I think they're safe unless Buffett's put a patent on seaplanes.

It certainly does suggest a familiar visible link to all things Buffett.
If he's got a TM on a logo w/seaplane (?), you know his shysters will be on top of it real quick! 8)

I doubt Buffett anymore has a TM on a logo with a seaplane than he does on using parrots and other tropic imagery in his artwork. If he does, those things aren't just unique to Jimmy Buffett.

Just because you wouldnt doesnt mean anyone else wouldnt be stupid enough not to trademark their symbol.

and its not just a seaplane, its a flying seaplane inside a circle with lettering following the symbol around the circle.

And the plane is called "Spirit of KEY WEST"!

Pretty similar imagery, that's for sure!

Is it possible, and I don't have a clue, that JB has something to do with this company? Just a thought.

If JB's lawyers make them change it, I say it should be a parrot holding a margarita flying a seaplane. They'd never be able to touch that one!

it's not new rum it's been around for quite a while, I bought some about 3 years ago in key west it's sitting in the bar in our house. They sold it in the old conch republic store in key west. So if Jimmy was going to get on top of it, he would have by now.

We bought a bottle to drink and a bottle just to have displayed in the bar. It's actually really good!

Yeah, we had some not too long ago, one of the best rums I've ever had.

I'm thinking that JB is well aware of this. Cruzan is a sponsor of MOTM

I didn't say anywhere in my post that I wouldn't sue so I'm not sure where you're getting that from.

I think if Buffett sues over these slight similarities it would be completely ridiculous. They may be similar images but they're not identical.

It doesn't have to be identical. If it's similar enough that a reasonable person would mistake it for the real thing he can sue to protect his copyright, if he has one.

In either case, I don't think it's enough of a similaritiy for Buffett to sue for. What I do see is fanaticism over Buffett gone awry. Last I checked, he doesn't have a TM on seaplanes, parrots, cheeseburgers or any of the other images associated with his persona.

The issue isn't what you think but rather what the law reads.

I never said the issue is "what I think" I'm just offering my opinion just as everyone else in this thread has (including the original poster) and I stand by that opinion: it's more a case of Buffett fanaticism gone awry.
