Security Guard Who Saw Ghosts Eligible For Unemployment

POSTED: 11:25 am EST November 17, 2005

DES MOINES, Iowa -- Here's an out-of-this-world reason you can't be denied unemployment benefits in Des Moines: seeing ghosts on the job.

The issue ended up in court when security guard Wade Gallegos alerted his supervisor at Neighborhood Patrol in September that ghosts were haunting a neighborhood he was guarding.

The supervisor arrived at the scene and Gallegos showed him where the ghosts were still apparently standing. The supervisor claimed he saw nothing and fired Gallegos five hours later.

The company found no signs of drug use or alcohol.

When Gallegos applied for unemployment benefits, Neighborhood Patrol refused, arguing that he was guilty of misconduct.

This month, Judge G. Ken Renegar disagreed. While he acknowledged that "such beliefs do render the claimant unfit to act as a security guard," Renegar ruled that seeing ghosts is not the type of misconduct that can disqualify Gallegos from receiving benefits.

the UI benefits are cheaper than if he hits them with a discrimination (under the Americans With Disabilities Act) or a wrongful discharge suit.

When I was taking Business Law in college, we studied a case in New York state where someone sold their house which turns out to have been haunted. The new residents eventually experienced the haunt(s) and then sued the original owners..... and WON! The grounds of the finding were that to sell a house it must be unhabited, or the buyer must be aware of any inhabitants. The previous owners disavowed any knowledge of the haunts or anythign else and billed the house as vacant, thereby making the sale void dince the haunt(s) was considered to be a current resident. The sale was overturned.

Now that's some funny stuff.
"Oh all the money that e'er I spent, I spent it in good company.
And all the harm that I ever did, Alas it was to none but me.
And since it falls, unto my lot, that I should rise and you should not
I'll gently rise and I'll softly call, 'Goodnight and Joy be with you all.'"
