might as well. if I have a choice between a guy on his third strike for violent felonies, or his third for just having marijuana in his possession, and 1 jail cell..

My opinion on this matter is irrelevant, however I think he may have shot himself on the foot with this one. Letting prisoners out of jail (even if it is to make room for more violent offenders) is not going to jive with the Texas public... I could be wrong though.

I highly doubt there's people in prison for ONLY smoking pot. If there is, let those folks go. If the marijuana offense is coupled with something violent, then by all means, don't let them out.

I think federal law would trump state law in this case anyhow... they've tried legalizing it here in Colorado, but it's still a federal crime...

It's legal in Denver proper for up to 1oz. However, shortly after the VOTERS passed the law, both the governor and the mayor said the state and federal laws would be enforced (although, each test of this has been thrown out in jail so far).

Colo voters collected enough signatures to put recreational marijuana use on the ballot (again for up to 1oz) for this November's election. My bet is that it will pass but the federal law will always be enforced.

OR, CA, and WA too I think have state laws that run counter to the Fed on the topic.
