(Given your recent arrival to BN and your posts focused on this topic, it appears you may be directly involved.) On another note, I read through the link and it's clearly messy legal stuff. This lawsuit seemed sloppy from the first news story I saw on it; I'm not sure anyone won this particular battle.

Sorry, I had closed peepers. Yes, I am connected to UnderOneHut.com as their webmaster. I got real tired of seeing these folks get railroaded. They are good people, just trying to make a living. They don't sell bootleg or counterfeit merchandise. Everything with Jimmy Buffett's name or likeness is authentic product. That was not in dispute. What is in dispute is that Jimmy Buffett and his people don't want any competition on the internet. That is the real issue here. I'll stand by my initial comments on this one...any direct trademark violating items needed to be removed -- whether 1% or 90% (the only black-and-white example I saw was merchandise containing "parrotheads".)
The whole thing should have been handled much more professionally and outside the courts (and press). Buzbee (Jimmy's local lawyer) showed himself to be a careless headline-seeker; he made Jimmy look very bad on this. Buzbee reached the goal line but left a path of destruction in his wake. Very sloppy.
And the judge should probably have his hands slapped for making Ackard's jail release for contempt contingent upon signing Buffett's agreement. That's close to extorsion.
Even if illegal and legal are black-and-white, in the gray middle people draw their line at different places along the continuum of ethics and integrity. Also, a lot of folks figure something is wrong only if they get caught...be it violating others' trademarks, or using legal power to limit competition.
If Jimmy's proud of how this was handled on his behalf, looking like a French druggie wasn't so bad.

I haven't followed the details of this closely, but I do know from my days of attendance at a law school that specialized in Intellectual Property that other individuals and companies, as big or bigger than Buffett, have done similar things over smaller intellectual property infractions.
This just happens to be the story we are all paying attention to because it involves Jimmy...think what you will of him but just know he doesn't hold the "trademark" on the perceived David and Goliath lawsuits.
