if you work ot on a week where there's a paid holiday
do you get paid the ot rate. Ex - you put in 41hrs in four days and then have off on the fifth as a paid holiday. Would you have put in 1hr ot or 9hrs.

Re: if you work ot on a week where there's a paid holiday
We don't get overtime pay; but with 41 hours worked in a holiday week - I would have recorded 32 regular hours, 9 hours of "casual overtime" and 8 hours of holiday time.OceanCityGirl wrote:do you get paid the ot rate. If you normally get paid for overtime, you should have been paid for 9 hours OT

Many years ago when I worked PT for a large grocery store chain, I got OT on sundays and after 8 hours in one day, no mater how many hours i worked that week. But i was in a union then

Our regular work day is 7 hours but the way they figure O.T. you don't get time + 1/2 until after 37 1/2 hours, not 35.OceanCityGirl wrote:do you get paid the ot rate. Ex - you put in 41hrs in four days and then have off on the fifth as a paid holiday. Would you have put in 1hr ot or 9hrs.

not saying you were in California, but California does that. Anything over 8 hours in a day, or is it 10? Anyway, over a certain number of hours in one day counts toward OT.myke212 wrote:most place i've worked I got the OT

Here in Colorado you'd need to put in 40 hours, then start getting OT.
I'd presume the answer to the initial question should be that anything over the 32 hours you worked should be OT, since the holiday made up the additional 8, getting you to 40 hours.
If you REALLY need to know, I can stumble the 10 feet and ask the HR helpdesk. I happen to work for the nations largest payroll company.

I work 12 hour shifts-four days one week and three days the following week. I end up working 84 hours in a two-week pay period, so there's four hours of overtime right there.
As for holidays, since my shift is 12 hours, I get 12 hours of holiday pay when I work on a holiday (or 12 hours of holiday pay the week of a holiday if the holiday is my regular day off-as long as I have at least 80 hours for that two week pay period). If I have the holiday off and work on that day, I get 12 hours of overtime for that day, and my holiday pay would come on my next regularly scheduled work day.
And if anybody here is clear on what I just said, I'll buy you a bottle of the most expensive tequila, wine, brandy, any of the above, any combination of the above, or ALL of the above.

Where I work (Union Job) you get OT (time and a half) any day you work over 8 hours. I work Sun to Thur. On Sunday I work 8.5 hrs, so I get 30 min of OT. Mon to Thur I work 10:15 min and get 2:15 of OT a day. So I get a total of about 9.5 hrs of OT a week. During a holiday week it gets interesting. Some holidays are considered Saturday service and some ore considered Sunday service. So if you normally work on Sundays you work days like Thanksgiving, X-Mas, Labor Day etc. If you work Saturdays you also work July 4th, and Presidents Day, no matter what day they fall. Because I work Sundays I also had to work Tday. So on T-day I got 8 hrs pay for the holiday and OT for what I actually worked, 8.5 hrs. Now if you work Mon to Fri you got the day off and got paid 8 hrs. Now normally if we come in on your day(s) off that entire day(s) is paid at OT, as long as you worked all of your normally scheduled days that week. If you got a day off because of a holiday the extra day is not OT. So last week anyone who worked their day off on Sat would not get OT if they had T-day off. Needless to say not many people come in on says they will not get OT.

Union pay for overtime would depend on what your contract says and that's usually an item to be negoiated at contract renewal time...Coconuts wrote:It depends on the company- the previous company I worked for would have paid OT (they paid OT even if you took vacation time!), but the two before that would have just subtracted off the holiday pay.
I worked in accounting for some years, and any O.T. had to be acutal worked hours over 40 hrs. in 7 day period was O.T., otherwise, be glad you got paid for the holiday..
it appears, by law, each state has somewhat different regulations.
