but...Was he song copywrited or in print anywere? I dont know how that works, but I would think if you write a song and dont protect it...its up for grabs.

The article says McCloud copyrighted the song in 1996 when it was recorded on a CD.

I think Toby Keith used the first song as inspiration for his and made it a little better. Aren't most songwriters inspired by other songwriters?

I dont know if he stole it or not so wont comment on that. It does seem like "It's A Little Too Late" to bring out a lawsuit almost 4 years later. Had that been my song, I would have jumped on it immediately. That's on him.

I do however have one gripe with Toby. While I was at a convention in Vegas this summer, someone from a vendor booth gave me a Toby Keith cowboy hat. He had a setup of Toby's I Love This Bar+Grill merchandise. great hat. Has his name on the inside, red, white and blue inner rim but than i saw it. The thing that made me upset.
Mr. "Angry American", "American Soldier", "Courtesy Of The Red, White And Blue", had this hat made IN CHINA!!!!! I am sure all of his merchandise is made there. But if you're going to spout out how you support your country, love your country and are so damn patriotic, than start by putting Americans to work!
I found it a little upsetting and quite disappointing. With that having been said, I am still a fan and if anyone is interested, Toby Keith tickets go on sale Saturday for the following venues:

This is simply a load of crap imo.
As a guitar player I know that Toby's song is musically nothing like McCloud's song. So what if Toby rhymes the word "losers" with "boozers".
I've heard the word "margarita" rhymed with "senorita" a bunch of times.
How many tropical anthems have subject matter similar to Margaritaville?
Just a whole bunch of nothin'.

Not all judges are musicians. Let's not forget when George Harrison was sued for plagiurism for his song, "My Sweet Lord" against The Chiffon's "He's So Fine."
Of course...the songs were practically identical but who knows for sure about this debate.

Kenny Chesney did Some People Change first a few albums back---now Montgomery Gentry have a number 1 hit with it. Most of the time the people who sing the song do not write the song. Look at Aerosmith--THEIR ONLY number one hit was a song they didnt even write---and actually it was done by MARK CHESTNUT before they even thought of covering it.

Almost half the time now when someone sings a song--they didnt even write it. Including Jimmy.
