Man Sues IBM Over Adult Chat Room Firing

A man who was fired by IBM for visiting an adult chat room at work is suing
the company for $5 million, claiming he is an Internet addict who deserves
treatment and sympathy rather than dismissal.

In papers filed in federal court in White Plains, Pacenza said the stress
[incurred in 1969 when he saw his best friend killed during an Army patrol
in Vietnam] caused him to become "a sex addict, and with the development
of the Internet, an Internet addict." He claimed protection under the
American with Disabilities Act.

As much as I totally dig posting on the internet, I just don't seem to recall seeing "internet posting" on the list of things covered under the Americans with Disabilities Act when I took Labor Relations Law.

I know that I could most likely be reprimanded (or possibly fired) for posting to BN during work hours....I work for the State and we have an "internet use policy".

But I don't think I would go so far as to sue someone, should I get caught and have to face the consequences...

right up there with the compassion for the drug addicts and alcoholics who get Medicare benefits because they are "disabled"

A couple of things from a guy who's in IT and monitors peoples web access.

Because they knew where he went, they obviously have monitoring software that can allow or disallow access to such web pages. I went to the site he accessed and even my most basic web filter would have denied access. In our company we do not grant everyone internet access just for being an employee. If you can show a business need for access and your manager or supervisor and the director of IS signs off then you get access to the internet with our filtering in place.
Reading the article, he had a prior run in with the "Web Police". In my company a first offense gets you to HR and a talking to about internet access and how and why you didn't follow the the policy you signed off on. Next time you're let go.
To me his argument is BS.

BTW, one of my standard filters blocks BN. No forum for me at work either. Well ummm, I do configure the filters sooooo.

hey I'm all in on this suing for my job enabling me to become addicted to p*** because I am allowed unlimited access to the internet from my desk. However if their of those you who feel p*** addiction isnt an acceptable need for rehab because I feel I am a fulfledged Parrothead I believe from now on I'm in on the three Margarita lunch and then I can get fired and then I can sue because I was able to come here and post anytime I wanted. Thanks guys I appreciate the input on my new get rich quick plan.
