It's my understanding in CT that throwing an object, ANY object, regardless of biodegradability, from a car is illegal.

In MA. it is a Criminal offense, under Ch. 90 S.22G (operator only??) Littering from a motor vehicle. Chapter 90 of the MA. general Laws refer to Motor Vehicle Law. Under Ch.270 S.16 & Ch. 270 S16a it is an arrestable offense. There is a separate Chapter and Section for throwing a lit cigarette from a motor vehicle onto a public or private way, Ch. 148 S.54 MAKE sure to do this when the police pull you over and the Officer is standing at your window, It will really make them happy. It will almost assure you a BIG ticket.

Yes, it's littering, and yes, I'd write anyone a ticket I see doing this.

Sorry-I'm not in this business to make friends, and couldn't care less who gets upset over me doing my job.
They'll either get over it or quit littering.

As I was walking to my car after work tonight, I saw an apple tossed next to the walkway with only like 2 bites out of it...........and I thought, "what a waste of a perfectly good apple....if i only knew who bit it, i'd possibly pick it up and take it home for the horses".

Even horses have standards, ya know. :D

Apparently, I have to stop feeding the squirrels and raccoons and rabbits along the empty country roads where I sometimes leave apple cores.... :roll:
Ontario Highway Traffic Act:

Every person who throws or deposits or causes to be deposited any glass, nails, tacks or scraps of metal or any rubbish, refuse, waste or litter upon, along or adjacent to a highway, except in receptacles provided for the purpose, is guilty of the offence of littering the highway. R.S.O. 1990, c. H.8, s. 180.

and:

the definition of "highway" in the Highway Traffic Act applies equally to provincial highways and to municipal roads. Perhaps I should read the definitions.

The highway definition in the Highway Traffic Act in section 1 provides, "`highway' includes a common and public highway, street, avenue, parkway, driveway, square, place, bridge, viaduct or trestle, any part of which is intended for or used by the general public for the passage of vehicles and includes the area between the lateral property lines thereof." In other words, it's fence to fence.

We should also probably look at the definition of highway in the Municipal Act which follows the definition in the Highway Traffic Act quite closely, and it says, "`highway' means a common and public highway, and includes a street and a bridge forming part of a highway or on, over or across which a highway passes."

As a biker, I have done exactly that. It generally frightens people beyond beleif. When I am on my bike, and someone throws something out of their car, I think it should be considered not only littering, but assault as well. Also, as a fire fighter, I have been called out to many a brush fire along a dry highway....the cause of some of these? Cigarette butts. People are dumb.
That situation happened several months ago near where I live. Someone flicked their smoke outta their car and it landed on another person's car. Road rage ensued and the guy who did the flicking was shot and killed by the guy who go the smoke flicked on his car.
