Noisy Neighbors
I was wondering if anyone else has to deal with this and what you've done about it. The upstairs neighbor is constantly making noise and I have tried nicely to speak with him to no avail. I spoke with the apartment manager to no avail. Should I call the police? Should I bang on the ceiling? Any advice?

So, I take it your neighbor is not "quietly making noise"?
If you bang on the ceiling, you have a rivalry. If you call the cops, you have a rivalry.
How long is left on your lease? When can you and your woman buy a house?
Maybe you should go to his door, dressed to the hilt in priestly garb?
Or you could just pray for quiet.

We just signed the lease in September. I think I might already have a rivalry because my attempts to talked to him have made him mad at me. And I promise I was nice. Can you ask the Apt manager if you can move units?
Unfortunately, they won't do anything about the noisy folks unless they aren't paying the rent, damaging the place or violating the lease in some way that's gonna cost them $.
Since you've only been in your unit such a short time, they shouldn't have to clean your place much to re-let it.

Well the problem is that his son (or somebody's kid) has come for the weekend. He obviously doesn't have regard for his neighbors and is in cahoots with the manager. So my thoughts were to ask him when this kid is going to come and stay the weekend and just vacate the place on those days. We go and stay with my mom on Saturday nights anyway cause it is much closer to the churches, we can just add Friday night to it.

If you're going to call the cops, check with the laws of your municipality to see if they are doing anything the police can even get involved with. It may be a matter of civility and not legality. As much as it s***s to have to be the "bigger person" and basically move out every weekend, it might be your best option.

I guess I should also say that the dude is the maintenance guy for the complex.
Maybe I am off, maybe I expect too much from people. I just want to live quietly and peacefully with those around me, but everyone else doesn't want this. I should not have to listen to banging around every hour of the waling day. (I will give them that at 10pm the noise stopped and was quiet during the night) I guess we are going to have to buy a house which is what we should have done in the first place.

Make your concerns known to management in WRITING via certified mail and request to be moved to an upstairs apartment.
If they fail to act, check your lease. You may have cause to break the lease if they fail to provide a certain level of quality housing.
This is a tough situation and why we specifically leased an upstairs unit when we were apartment dwellers.

Don't complain to the manager. Complain to the manager's boss - the owner or head of the management company.
Detail what's been going on, what you've done about it and that you've been ignored because of the friendship between the maint guy and manager. Send the letter via certfied mail (which to them usually means lawsuit - they'll be relieved that it's just a complaint versus a Complaint) and in your letter advise that you are going to go to your community's Better Business Bureau and Chamber of Commerce to make a record of your dissatisfaction so that other propective tenants know how that complex treats its tenants. Give them 14 days to correct the situation.
Also, you are entitled to enjoy "quiet enjoyment" of your premises. You could potentially withhold a portion of your rent for those days on which you record noise. That will likely end up in front of a judge.
I am guessing the OWNER will care and he'll force the manager to do something. The manager may have hired a friend as the maint man. I see that all the time when I have to sue shoddily run apt complexes.

Being the noisy neighbor
I can tell you it has to deal with respect towards others. There's many a day when my windows are open and the stereo is a little too loud my neighbor comes a knocking, I simply oblige as it's a very reasonable request. There's other times I'm on my patio and he on his and I simply ask is the music bothering you. On the other hand he has never complained once about my children being loud when they are outside playing showing me the same courtesy, understanding that children need to get that energy out. I know it doesn't help your situation any, I also realize you know exactly what kind of person your dealing with, a disrespectful SOB

I did go and speak to my neighbour at a time when the music was not loud and told him that it was affecting my quality of life - and that worked a little ...

I am currently dealing with this problem now and the with the previous tennant. The nice approach has worked for the current neighbor. We had to call the police, a lawyer and immigration services for the previous neighbors.
We live next door to you in Virginia and it is stated in the landlord/tennant rights act that you have the right as a leasee (sp) with in reason to live a quiet and non hostile environment.
We had illegals living above us and on black friday 3 years ago at 5am, 2 truck fulls of their relatives or about 20 in all showed up. It is pretty darn loud with 5 folks above you just imagine 20 plus and at 5am. The office did absolutely nothing about it even though they were in violation of virginia fire code. After countless trips upstairs and countless broom hits on the ceiling, we retained a lawyer and he contacted immigration for us. With in 2 weeks of threatening to sue the complex for violation of our lease with direct quotes from the tennant act the family was gone.
I try to get along with my neighbors and be as cordial as possible but there comes a time where enough is enough and you start to lose your sanity. If this problem continues do not hesitate to call the police or contact a lawyer, it is your home and you have the right to live in peace. Like other folks said the office won't do squat about it unless you show them you mean business.
