Some of the comments in our local online paper noted the rather disturbing violations of civil liberties by this particular sheriff's department - breaking into locked rooms while looking for drunk teenagers, testing *89* kids for drunkenness - you'd think they might have gotten the idea around number forty or so. Where were their warrants to break and enter?
But yeah...the kids who organized this had a way cool idea. Too bad it exposed exactly what sort of doofi they have for law enforcement.

They DID have probable cause to enter the house and breathalize those they saw drinking out of cups near a keg in plain view (although I dont agree with how many they did), but they did not have cause to enter into locked areas without a warrant unless the homeowner gives them consent (which I doubt is a highschool kid, and it sounds like no parents were home, so I am doubting they had any consent). I am not a cop, but Criminal Justice is my minor. I may be way off and totally wrong, but I think that is how the law worksTropicalTroubador wrote:Some of the comments in our local online paper noted the rather disturbing violations of civil liberties by this particular sheriff's department - breaking into locked rooms while looking for drunk teenagers, testing *89* kids for drunkenness - you'd think they might have gotten the idea around number forty or so. I don't see that as probable cause.UpstateNYPH wrote:They DID have probable cause to enter the house and breathalize those they saw drinking out of cups near a keg in plain view
Granted, a keg is likely filled with alcohol, but if they just tested the stuff in the keg, there was no need to breathalyze anyone.

What if the root beer in the keg was MIXED with alcohol? There is no way to test for alcohol other than to breathalyze. The cops cant drink a cup of it to find out...SharkOnLand wrote:I don't see that as probable cause.UpstateNYPH wrote:They DID have probable cause to enter the house and breathalize those they saw drinking out of cups near a keg in plain view

While I dont agree with testing 89 freaking people, I do agree with the fact that some needed to be breathalyzed to determine the liquid.

I'm pretty sure they make test strips (like you'd use for pH) that can detect the presence of alcohol in a liquid.UpstateNYPH wrote:What if the root beer in the keg was MIXED with alcohol?
