WTH????? The owner acknowledges they got bad service and stated the manager offered to comp the meal. So if the mgr agreed to comp why arrest them for failing to pay a tip that was put on the bill?

I've never heard of a mandatory gratuity, is this something that is printed on the menu so you know about it before you order?

The restaurants I've eaten in that had mandatory gratuity for large groups had it printed on the menu.

Especially since tips are figured as a percentage of the bill. Even twenty percent of zero is still zero.

The manager agreed to comp the meal and they didn't take him up on it? I call BS.

i dunno... you may be right, but it sounds to me like they were trying to prove a point. "we aren't out to get something for nothing. we just don't think we should HAVE to tip for bad service"
i get frustrated sometimes with folks not getting my order right because i am vegetarian. i can't eat it, if it has meat on it. but i feel bad about always having to send stuff back.
usually if they offer to comp the meal, i turn them down if it was just a matter of it coming out wrong the first time and they fixed it quickly.
tho, one time i had a manager refuse to print me a bill and run my credit card. i didn't bring any cash with me, so there was nothing i could do. he was frustrated because i came in a lot, and the staff messed up my cheese fries EVERY time i came in there.
they treated me like the devil everytime i came in there after that, and i finally had to stop eating there. which is frustrating because it's across the street from my office and the food is good.

The police arrested the couple because the tip was included on the bill and, in the eyes of the police, they were refusing to pay a portion of the bill, which is theft. However, no matter how it is phrased on the menu, any included gratuity is only a suggestion and does not have to be paid.

That could be the case, but why would the manager agree to have the police called if he
offered to comp the meal? I'm betting that the offer was never extended to them.

the article said the bartender called the police, but i'm sure the manager became aware of it at some point...

I know some who suggest that because it is printed on the menu it is an implied contract, if that is the case, the other side of that contract is that the service that is being paid for is rendered and in this case, it wasn't.
