Her response to the question on First Amendment protections was, ""I understand and am grateful for the protections we enjoy under the U.S. Constitution, but the First Amendment does not extend to all types of speech," Durham said. "Due to my strong Christian beliefs, and my respect for the convictions of other, I personally feel that burning sacred texts goes too far." The text of the amendment does not specify certain types as being afforded more protection than others. She does qualify it, but her qualification is her opinion, and why there is no specifics in the amendment.

Actually according to the article that was the statement that was released Tuesday through the through state pageant officials.

If I were Penn Jillette and my career had declined to the point of being a Miss USA judge...I would just keep my yap shut. I wouldn't publicize it.

OK here is where I have an issue with the whole Free Speech thing

Speech is just that Vocal... to extend Burning of anything as "free speech" is silly vocal is not action

to extend burning a flag/book/record.... is over the line (IMHO)

I was almost hit in a crosswalk Sunday night the driver ran the red
(he wanted to make a right) and THEN flipped me off while I jumped back.. Words failed me at that point..
had I been able to extend my rights.. I
A would have p*** in his window
B would have punched him..
But you and I know I would have been arrested.. for either

and really? to the point? as a Judge.. he is not supposed to care
who wins or loses..

While I appreciated all the Southern belles that made it all the way to the Final 4, I had to go with the redhead to win. And at least she paid her respects to a fine southern tradition of evening gowns; her dress looked like it had been cut from the drapes at Tara... :D

Unfortunately you can thank some asshat that was a part of the "Corporate War Chest Tour" at the 1984 Republican convention for the burning of the flag to be covered under 1st Amendment. A group of protesters stole a flag, a guy was arrested and convicted of Desecration of Venerated Object which was a misdemeanor of the Texas Penal Code. Asshat took it all the way to the Supreme Court. I worked in the building they stole the flag from. We were on lock down which back in those days was a pretty freakish thing to happen. I just wanted to get the hell out of downtown in one piece. that day.
